4. Pricing and Payments
- All prices are listed in Australian Dollars (AUD) unless stated otherwise.
- Prices may be subject to GST, shipping, and handling fees.
- We reserve the right to correct pricing errors and cancel orders affected by such errors.
5. Orders and Acceptance
- All orders are subject to acceptance and product availability.
- We may refuse or cancel orders at our discretion, including for suspected fraud or incorrect pricing.
- Once an order has been processed or dispatched, changes may not be possible.
6. Shipping and Delivery
- Delivery times are estimates only and are not guaranteed.
- We are not responsible for delays caused by carriers, customs, weather events, or circumstances beyond our control.
- Risk of loss transfers to the customer upon delivery to the shipping carrier.
7. Returns and Refunds (Australian Consumer Law)
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL).
Under the ACL:
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are entitled to have the goods repaired or replaced if they fail to be of acceptable quality, and the failure does not amount to a major failure.
Change of Mind Returns:
- We are not required to provide a refund for change-of-mind purchases.
- If accepted, items must be unused, uninstalled, and returned in original packaging.
- Custom-made, special-order, or modified products are non-refundable unless faulty.
Shipping costs are non-refundable unless required by law.
8. Installation and Use Disclaimer
Professional installation is strongly recommended.
Genie Performance Headers is not responsible for damage, injury, or loss caused by incorrect installation, misuse, or modification.
Performance parts may affect emissions compliance, noise levels, vehicle warranties, and road legality.
9. Warranty
Products may include a manufacturer’s warranty where applicable.
Warranty does not cover damage caused by misuse, racing, improper installation, or normal wear and tear.
Any warranty provided is in addition to your rights under the ACL.
10. Limitation of Liability
To the maximum extent permitted by Australian law, Genie Performance Headers will not be liable for indirect, incidental, or consequential losses, including loss of profit, vehicle downtime, or loss arising from use of our products.
This clause does not limit consumer guarantees under the Australian Consumer Law.
